Yes, CBD is legal in Nebraska, as per the 2018 Farm Bill. However, it has to be hemp-derived and contain 0.3% or less tetrahydrocannabinol (THC).

After this legalization, in May 2019, Governor Pete Rickets issued a legal statement on the legality of CBD. By signing the Hemp Farming Act, the governor allowed hemp cultivation and sales as long as the product is hemp-derived with 0.3% THC or less.

According to this requirement, CBD products have to be tested and approved by the Department of Agriculture in Nebraska before they reach the market. This process ensures that vendors and growers fully align with the Nebraska laws.

From these two Nebraska laws, any CBD product that contains more than 0.3% THC is illegal. THC is a psychoactive drug that can significantly affect how your brain functions.

Although CBD can also be derived from marijuana, the Nebraska government prohibits it since marijuana is still illegal here. Some marijuana extracts contain up to 90% THC.

Nebraska CBD Possession Limits

There are no possession limits to any CBD product that meets the state’s requirements. As long as the CBD in your possession is hemp-derived and sold under Nebraska regulations, then it’s legal.

That is, the CBD is hemp cultivated and contains no more than 0.3% THC.  It’s also legal to transport CBD products from hemp-cultivated plants that contain the required THC levels.

Regardless of its use, marijuana remains illegal in Nebraska because of this law. Therefore, there’s no way you can get a medical marijuana card in Nebraska.

In 2015, for instance, there was a proposal for the Cannabis Compassion and Care Act (LB643) in Nebraska that never saw the light of the day. This proposal was to legalize the use of medical marijuana for terminally ill patients in the form of pills and liquids.

A similar bill (NE LB474) seeking to legalize medical marijuana in Nebraska flopped in May 2021.

That said, things may soon change if we’re lucky enough. A group dubbed Nebraskans for Medical Marijuana seeks to qualify medical marijuana initiatives for the 2022 ballot. This movement is currently on a signature drive and aims to collect over 200,000 signatures.
