Is CBD Legal in Michigan? (Laws & Regulations)
Can using, buying, or possessing CBD get you arrested in Michigan? The answer is no. Michigan legalizes the use of CBD derived from both Hemp and marijuana. However, the state has enacted different laws to control CBD use for medical and recreational purposes.
Here's an overview:
2008: Michigan Medical Marijuana Act
Michigan State legalized cannabis-derived CBD under the 2008 Michigan Compassionate Care Initiative and the Michigan Medical Marijuana Act.
According to the Initiative, CBD derived from marijuana wouldn't be regulated as marijuana if the THC content is less than 0.3%. It was used to treat patients with debilitating conditions like:
- Glaucoma
- Cancer
- Nail patella
- Hepatitis C
- Acquired immunodeficiency syndrome (AIDS)
- Alzheimer's disease
- Crohn's disease
- Persistent muscle spasms
- Post-traumatic stress disorder
- Amyotrophic lateral sclerosis (ALS)
- Human Immunodeficiency Virus (HIV)
- Tourette syndrome
- Obsessive-compulsive disorder
Also, medical conditions that produced the following symptoms qualified for medical marijuana:
- Autism
- Parkinson's disease
- Severe nausea
- Rheumatoid arthritis
- Cachexia
- Severe nausea
- Ulcerative colitis
- Chronic pain
- Epilepsy/ seizures
- Spinal cord injury
- Inflammatory bowel disease
The Act also authorized the state to implement rules about the distribution of medical marijuana and impose a fee on qualifying patients.
Patients were also allowed to grow marijuana as a source of medicine, but it was restricted to 12 plants only in an enclosed facility. The Act also allowed residents to obtain licensure as medical marijuana growers.
2018: Michigan Regulation and Taxation of Marijuana Act
This legalization resulted from the introduction of the Michigan Regulation and Taxation of Marijuana Act in November 2018 that allowed residents over 21 years to consume, possess, cultivate, and process recreational marijuana.
2019: Michigan Industrial Hemp Research and Development Act
Later the state enacted the Michigan Industrial Hemp Research and Development Act of 2019, which legalized CBD derived from Hemp. The Act describes industrial Hemp as cannabis containing less than 0.3% THC (tetrahydrocannabinol) in concentration by dry weight.
Despite the legalization, the state prohibited hemp-derived CBD as a dietary supplement, additive in foods or beverages in line with FDA directives.
Marijuana-based CBD with a THC concentration of more than 0.3% is classified and regulated under laws governing marijuana under the Michigan Department of Licensing and Regulatory Affairs.
Michigan CBD Possession Limits
There are no possession limits for CBD derived from Hemp, but the state limits the amount of marijuana one can possess. Michigan residents (over 21 years) can only possess up to 2.5 ounces of marijuana in public and up to 10 ounces at home.
This limit also applies to patients, but they can't exceed 10 ounces in a month. If found in possession of more than 2.5 ounces up to 5 ounces, you're charged with a civil infraction and fined $500 if you're a first-time offender.
If in possession of more than five ounces, you're charged with a misdemeanor and applied a fine of $500. If growing the plant, the state allows the cultivation of up to 12 marijuana plants according to the 2018 Michigan Regulation and Taxation of Marijuana Act.
How to Get a Medical Marijuana Card in Michigan
Patients eligible for medical marijuana must apply for a Medical Marijuana Card, which grants access to the drug.
The application process is pretty straightforward, and we've outlined below:
- Create an account: Visit the Marijuana Regulatory Agency website and create a password and username for your account.
