In terms of recreational marijuana laws, Hawaii has attempted to pass legislation annually in recent years.

In 2019, Hawaii approved a law that eliminated criminal penalties for possession of up to three grams of marijuana for personal use. Instead of criminalization, possession would be subject to a fine up to a maximum of $130. 

On February 16th, 2021, the State Senate voted to advance two marijuana bills. One would increase the recreational amount to one ounce (28 grams), and the other would legalize recreational cannabis for adults 21 years and over.

Hawaii CBD Possession Limits

It’s tempting to want to go and buy as many CBD products as you can. However, you may be concerned that there is a limit on how much CBD you can own at one time.

As we mentioned above, technically, CBD is legal in Hawaii if it comes from a hemp plant. 

Federal law protects products made from hemp. Consumers can purchase them in any state despite Hawaii’s previously anti-CBD policies.

However, they also legalized the plant in 2017. This federal law means you can possess any amount of CBD as long as it is under 0.03% THC and comes from a hemp plant. 

How to Get a Medical Marijuana Card in Hawaii

If you’re looking to get all types of marijuana products before Hawaii’s legalization laws potentially come into effect, then your best bet is a medical marijuana card

Doctors and patients in the US have used medical marijuana cards for decades as a means to circumnavigate state and federal laws regarding marijuana usage.

Depending on the state, you may have to go to a physician with specific qualifications to obtain one.

Some of the reasons for getting an MMJ include severe illnesses, such as glaucoma or cancer, but you can also get one if you have anxiety or trouble sleeping. 

Hawaii launched its medical marijuana program in June 2000. To get a medical marijuana card in Hawaii, just follow the steps below:

Step One: Register Online

In the past, this process was a lot harder because you needed to prove Hawaiian residency. In March 2019, the state government also opened its MMJ system to state visitors as well.

You just go to and find their medical marijuana program application.   

To sign up, you will need: 

  • An email address
  • A computer
  • A photo of your ID uploaded on digital format

Your application needs to match your ID precisely. Any conflicting information will result in immediate denial of an MMJ.

Step Two: Get Approval From a Doctor

The physician you choose should be related to the condition you want marijuana to help alleviate. For example, if you want an MMJ card for glaucoma, it makes sense to choose an eye specialist.

Trouble with IBS? You may want to consult with a gastroenterologist for approval. 

Keep in mind that Hawaii is very serious about its medical marijuana program and will smell false symptoms and reports from a mile away.

Once you’ve found a physician and explained why an MMJ card is right for you, they will fill out their portion of your online application.

The name of MMJ cards in Hawaii is 329 cards. If you’ve been successful, your card will arrive in two to five weeks after the Hawaiian health board approves your application.

You will also receive an email confirmation. 

If necessary, you can print a certificate online that also proves your registry in the Hawaiian medical marijuana program. However, most dispensaries prefer the card, and you will need to use it as soon as you get it.

Up until 2015, these Hawaiian medical marijuana cards were a bit of a catch 22. While you could be approved for medical marijuana as early as 2000, the first dispensary in the state was not approved before 2015, and the law specified no means of production.

Despite Hawaii’s confusing CBD laws, it’s sold by most convenience stores and other shops, similar to the majority of states in the US.

First of all, not just anybody can grow cannabis in Hawaii. There is a section of the medical marijuana application that applies to this directly. In the application, you will have to indicate your intent to grow your supply.

As we mentioned above, dispensaries in Hawaii are few and far between, so this option is one to consider if you’re living on an island that is Maui or Hawaii. 

Once your application is approved, you can grow up to ten plants regardless of their stage of maturation. You’ll also want to be careful about how frequently you harvest, as you can only possess up to four ounces of usable cannabis at a time.

Where Can I Use My Marijuana?

As with most states that have legalized or decriminalized cannabis, it can only be consumed in private. More specifically, in a private location that has no anti-smoking policies. 

If you take your marijuana to the beach and smoke it, you can still be arrested in Hawaii, regardless of medical marijuana card possession. The safest place to smoke marijuana is in your own place of residence. 

The same rules for marijuana apply to CBD, so we recommend consuming your CBD in a private and secluded location.

How Can I Obtain a Grow License in Hawaii?

Hawaii has prohibited all outdoor growing in the state. It is challenging to get a license to produce marijuana in Hawaii, so most dispensaries import their products from other states like California. 

However, there is a transparent process on how to open a dispensary in Hawaii. Applicants just need to meet a series of requirements, and they will be eligible to open a shop. 

A dispensary applicant needs to be at least 21 years old, pay a $5000 application fee, prove financial resources in excess of $1,000,000 (plus $100,000 for each additional location).

Your dispensary will be limited to three locations. It must be enclosed and invisible to view from the outside. Once it’s open, you cannot advertise but may maintain a website.

Most products are legal to sell at dispensaries, except edibles. Lozenges are the only legal edible available in Hawaiian dispensaries.
